REACH, the new EU Chemicals Regulation (1907/2006/EC), will have a major impact on companies exporting chemical substances to the European Union (EU).

On November 30, 2008, all chemicals brought into the EU market must be pre-registered, either by your EU clients or by a legal entity of your company in the EU.

 

If not, the EU may close its market to your products. To avoid this, you can either support your customers in the registration process, or appoint an ‘Only Representative' (OR).

 Only one acceptable solution

If you want to stay in control, you should appoint an Only Representative (OR) and pre-register all substances you export to the EU market before November 30, 2008.

The REACH regulation provides room for several ways to appoint an OR. However, there is only one solution that comes with an acceptable level of risk: an OR legal entity over which you have complete control.

 The advantages of an Only Representative

An Only Representative (OR) is an EU-based legal entity appointed by you, the non-EU producer or formulator of a chemical substance or preparation, or products containing such substances or preparations.

By appointing an Only Representative (OR), you relieve your EU buyers of the obligation to register your product, while reducing your own communicative burden. It will also reduce your obligation to share health and safety data with the rest of the supply chain.
